Terms of Service

1. Acceptance of Terms

By accessing or using the OG Image API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, don't use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

2. Description of Service

OG Image API is a RESTful API service that generates Open Graph images programmatically. The Service allows you to:

• Generate social media preview images via API calls
• Use pre-built templates or customize image parameters
• Integrate image generation into your applications and workflows

3. Account Registration

To use the Service, you must:

• Create an account with a valid email address
• Provide accurate and complete registration information
• Keep your API key confidential and secure
• Be at least 13 years old (or the minimum age in your jurisdiction)

You are responsible for all activity under your account, including any misuse of your API key.

4. API Usage Rules

Acceptable Use

You may use the Service to:

• Generate images for your websites, apps, and social media
• Automate image creation as part of your publishing workflow
• Create images for commercial purposes within your plan limits

Rate Limits

API requests are subject to rate limits based on your plan:

• Free: 25 images/month, 10 requests/minute
• Starter: 500 images/month, 60 requests/minute
• Pro: 2,000 images/month, 120 requests/minute
• Agency: 10,000 images/month, 180 requests/minute
• Publishing: 50,000 images/month, 300 requests/minute

Exceeding rate limits may result in temporary blocks or additional charges for overage.

5. Prohibited Uses

You may not use the Service to:

• Generate illegal, harmful, or abusive content
• Create images that infringe on copyrights, trademarks, or other intellectual property
• Produce deceptive content intended to mislead or defraud
• Generate NSFW, pornographic, or sexually explicit content
• Create content that promotes violence, hatred, or discrimination
• Attempt to reverse-engineer, hack, or disrupt the Service
• Resell or redistribute the API as your own service
• Use automated tools to scrape or harvest data from our systems
• Circumvent rate limits or usage restrictions

Violation of these prohibitions may result in immediate account termination without refund.

6. Pricing and Payment

Subscription Plans

Paid plans are billed monthly or annually in advance. Prices are in USD and subject to change with 30 days notice.

Free Tier

The free tier provides 25 images per month. This is a hard limit—generation stops when quota is reached.

Overage Charges

For paid plans, usage beyond your monthly quota incurs overage charges at the rate specified in your plan. Overage is billed at the end of each billing cycle.

Refunds

We offer refunds only in the following cases:

• Service outage exceeding 24 consecutive hours (pro-rated credit)
• Accidental duplicate charges
• Within 7 days of first subscription if you haven't exceeded 10% of your quota

Cancellation

You may cancel your subscription at any time. Access continues until the end of your current billing period. No partial refunds for unused time.

7. Intellectual Property

Our IP

The OG Image API service, including its code, templates, documentation, and branding, is owned by OG Image API. You may not copy, modify, or distribute our software.

Your Content

You retain all rights to the content you provide (titles, images, logos, etc.) and the images generated using that content. We claim no ownership over your generated images.

Template License

Images generated using our templates may be used for any lawful commercial or personal purpose without attribution.

8. User Content Responsibility

You are solely responsible for:

• The content you provide to the API (text, images, URLs)
• Ensuring you have rights to use any logos, photos, or assets you include
• Compliance with applicable laws regarding the images you generate
• How you use and distribute generated images

We do not review or moderate the content of generated images.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service is provided "as is" and "as available."

We may:

• Perform scheduled maintenance (with advance notice when possible)
• Modify or discontinue features at any time
• Temporarily suspend service to address security issues

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM

11. Indemnification

You agree to indemnify and hold harmless OG Image API, its officers, employees, and affiliates from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you provide to or generate through the Service

12. Termination

By You

You may close your account at any time by emailing support@ogimageapi.io or through your dashboard settings.

By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Fail to pay for services
• Engage in fraudulent or abusive behavior
• Use the Service in a way that threatens our infrastructure

We will provide notice when possible, but reserve the right to terminate immediately for serious violations.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and OG Image API regarding the Service.
